Terms of Service - Nyndoo

Welcome to Nyndoo.

These Terms of Service ("Terms") govern access to and use of the website https://nyndoo.com ("the Site") as well as the services provided by Nyndoo. By using the Site and our services, you fully accept these Terms.

1. Service description

Nyndoo is an online service that automatically generates, schedules, and publishes content on social networks (LinkedIn first, with Instagram, TikTok, Facebook, and X coming soon) based on a business profile provided by the user.

Content is created by artificial intelligence models and then published through the platforms' official APIs after the user has authorized Nyndoo to publish on their behalf (OAuth).

2. Account and access

Accessing the service requires creating an account. A free 7-day trial is offered. After this period, access to paid features requires an active subscription (Essentiel €50/month, Pro €80/month, or Business by quote).

The user agrees to provide accurate information and not to share their credentials.

3. Ownership of content

Content generated by Nyndoo from the information provided by the user belongs to the user. The user remains solely responsible for the posts made on their behalf on their social accounts and warrants that they comply with the terms of third-party platforms (LinkedIn, Meta, etc.) and applicable laws.

Nyndoo claims no commercial exploitation rights over the posts generated on behalf of the user.

4. Subscription, payment, and refunds

Payments are processed by Stripe. The subscription is billed monthly and renews automatically. The user may cancel at any time from the billing area; cancellation takes effect at the end of the current period.

A full refund may be requested within 7 days of the first payment, provided the paid features have not been used intensively. Beyond that, no pro-rata refund is due.

5. Data collected

Nyndoo collects the data necessary to operate the service: email, business profile (brand, target, tone, objectives), payment information (handled by Stripe), OAuth tokens for connected social networks (encrypted in the database), and publishing history.

6. Service availability

Nyndoo strives to keep the service available 24/7 but does not guarantee absolute availability. Interruptions related to maintenance, third-party APIs (LinkedIn, Meta, OpenAI, Stripe), or force majeure may occur.

In the event of a prolonged outage of a third-party API preventing automatic publishing, no compensation is owed by Nyndoo.

7. Prohibited uses

The user agrees not to use Nyndoo to:
- Publish illegal, defamatory, hateful, pornographic content or content that infringes the rights of others;
- Spread misleading, false, or disinformation content;
- Spam or circumvent the limits of connected platforms;
- Reverse engineer, copy, or resell all or part of the service.

Failure to comply results in immediate suspension of the account without refund.

8. Liability

Nyndoo acts as a technical provider. The user remains solely responsible for the content published on their behalf and the consequences (legal, commercial, reputational) that result from it. Nyndoo cannot be held liable for the moderation decisions of third-party platforms.

9. Changes to the Terms

Nyndoo reserves the right to amend these Terms. Users are notified by email at least 15 days before substantial changes take effect. Continued use of the service constitutes acceptance of the new Terms.

10. Governing law and jurisdiction

These Terms are governed by French law. Any dispute relating to their execution shall fall under the exclusive jurisdiction of the courts of the registered office of the publisher, subject to the mandatory provisions applicable to consumers.
